Narrated from Aishah (RA) that Allah’s Apostle ﷺ said: "Avert the legal penalties from the Muslims as much as possible, if he has a way out then leave him to his way, It is better for the Imam to make a mistake while forgiving than making mistake in punishment." (Another chain) which is similar to the narration of Muhammad bin Rabi'ah (a narrator in no.1424) but he did not narrate it in Marfu' form.

Chapter No: 3

Narrated from Abu Hurairah (RA) that Allah’s Apostle ﷺ said: "Whoever frees a Muslim from any hardship of this world, Allah will remove from him of a hardship from the hardships of the Hereafter. And whoever conceals (the faults of) a Muslim, Allah will conceal (his faults) for him in the world and the Hereafter. And Allah keeps on helping the worshipper as long as the worshipper is engaged in helping his brother." Asbaat bin Muhammad reported it from Al-A'mash who said: "It has been narrated to me from Abu Salih, from Abu Hurairah (RA), from the Prophet (ﷺ)," and it is similar.

Salim narrated from his father (Ibn Umar) that Allah’s Apostle ﷺ said: "A Muslim is the brother of another Muslim, he doesn't oppress him and doesn't put him into ruin, and whoever is concerned for the needs of his brother, Allah is concerned for his needs, and whoever frees a Muslim from a hardship, Allah will remove from him a hardship from the hardships of the Day of Resurrection and whoever conceals (the faults of) a Muslim, Allah will conceal (his faults) on the Day of Resurrection."

Chapter No: 5

Narrated from Abu Hurairah (RA) that Ma'iz Al-Aslami came to the Apostle of Allah ﷺ and said that he had committed fornication, so he ﷺ turned face away from him. Then he came from his other side and said: “O Messenger of Allah ﷺ! I have committed fornication.” So, he again turned his face away from him. Then he came from his other side and said: “O Apostle of Allah ﷺ! I have committed fornication.” So, upon the fourth time he gave the order (for stoning). He was taken to Al-Harrah and stoned with rocks. When he was stoned, he started running swiftly until he passed by a man with a camel whip who beat him with it, and the people beat him until he died. They mentioned to the Apostle of Allah ﷺ, that he ran upon feeling the rocks at the time of death. So, the Apostle of Allah ﷺ said: “Why didn't you leave him?"

Narrated from Jabir bin Abdullah (RA) that man from the tribe of Aslam approached to the Prophet ﷺ and confessed fornication. He turned away his face from him, then he confessed (again). Then again, he turned away his face from him, until he had testified against himself four times. So, the Prophet ﷺ said: "Are you insane?" He said: "No" He said: "Are you married?" He said: "Yes". So, he gave the order and he was stoned at the Musalla. He fled when he was stuck by the stones, and he was caught and stoned until he died. So, the Apostle of Allah ﷺ spoke well about him but he did not offer the (funeral) Salah upon him.

Chapter No: 6

Narrated from Aishah (RA) that the affair of a woman, from the tribe of Makhzum who stole, really grieved Quraish. So, they said: 'Who can speak about her to the Apostle of Allah ﷺ?' They said: “Who can dare to speak other than Usamah bin Zaid (RA), the one dear to the Apostle of Allah ﷺ?' So Usamah spoke with him, the Apostle of Allah ﷺ said: 'Do you intercede about a penalty from Allah's penalties?' Then he stood up and gave sermon (to the people) saying: 'Those before you were only destroyed because when a noble person among them stole, they used to leave him. And if a weak person stole, they used to inflict punishment upon him. And by Allah! If Fatimah bint Muhammad (RA) had stolen, then I would cut off her hand."

Chapter No: 7

Umar bin Al-Khattab (RA) said: " Allah’s Apostle ﷺ stoned, Abu Bakr (RA) stoned, and I stoned. If I didn't dislike that I add to the Book of Allah. I would have written it in the Mushaf, for I fear that some people will come, and they will not find it in the Book of Allah, so they will deny it."

Umar bin Al-Khattab (RA) said: "Indeed Allah (AWT) sent Muhammad ﷺ with the truth, and he revealed the Book to him. Among what was revealed to him was the Ayah of stoning. So, the Apostle of Allah ﷺ stoned, and we stoned after him. I fear that time will pass over the people such that someone will say 'We do not find stoning in the Book of Allah.' They will go astray by neglecting an obligation which Allah revealed. Indeed, stoning is the actual punishment for the one who fornicates while he is married provided there are witnesses, or he confesses himself, or pregnancy makes it known."

Chapter No: 8

Narrated from Abu Hurairah (RA), Zaid bin Khalid, and Shibl, that they were along with the Prophet ﷺ when two men came to him quarreling. So, one of them stood before him and said: "I ask you by Allah, O Apostle of Allah! ﷺ, judge between us according to the book of Allah." So, his contender said - and he was more eloquent than him: "I agree of O Messenger of Allah! ﷺ Judge between us according to the Book of Allah, and let me speak. My son was a laborer for this man, and he committed fornication with his wife. So, they told me that my son was to be stoned. So, I gave one hundred female sheep and freed a slave as an expiation. Then I met some people from the people of knowledge, and they said that my son would be lashed one hundred times, and he would be exiled for one year while the stoning is only for this man's wife." So, the Prophet ﷺ said: "By the One in Whose Hand is my soul! I will judge between you two according to the Book of Allah. The one hundred female sheep and the female slave should be returned to you. For your son is one hundred lashes and exile for one year. O Unais! Go to this Man's wife, and if she confesses then stone her." He went to her and she confessed, so he stoned her.

Narrated from Ubadah bin As-Samit (RA) that Allah’s Apostle ﷺ said: “Take from me. Indeed, Allah has made a way for them: For the married person who fornicates with a married person the punishment is one hundred lashes, then stoning. And for the virgin who fornicates with a virgin there are one hundred lashes and exile for one year."

Chapter No: 9

Narrated from Imran bin Husain (RA) that a woman from Juhainah confessed before the Prophet ﷺ that she had committed fornication, and she said: “I am pregnant.” So, the Prophet ﷺ called for her guardian and said: “Be kind to her and if she delivers her child then let me know.” So, he did so, and then he ﷺ gave the order that her clothes be bound tightly around her. Then he ordered her to be stoned and she was stoned. Then he offered (funeral) Salah for her. So. Umar bin Al-Khattab (RA) said to him: “O Messenger of Allah! ﷺ You stoned her then you prayed for her?” He said: “She had repented a repentance which, if divided among seventy of the people of Al-Madinah, it would have sufficed them. Have you ever seen something more virtuous than her sacrificing herself for the sake of Allah?'"
